Overseas Vietnamese: the Changes in the Vietnamese Nationality Law 2025

1. Electronic Identity Card as Proof of Vietnamese Nationality

Article 1(2) of the 2025 Amended Nationality Law now includes electronic identity cards as valid documents to prove Vietnamese nationality, in addition to traditional paper documents such as birth certificates, passports, naturalization decisions, etc.

2. Relaxation of Conditions for Acquiring Vietnamese Nationality

The conditions for acquiring Vietnamese nationality have been revised to be more lenient in certain cases. For example:

- Spouses or children of Vietnamese citizens can apply for Vietnamese nationality without needing to meet language proficiency, residence duration, or financial self-sufficiency requirements.

- Individuals with Vietnamese parents, grandparents, or those with significant contributions to Vietnam's development and national security can also apply without meeting all the standard conditions.

3. Retention of Foreign Nationality Upon Naturalization

The law now allows certain individuals to retain their foreign nationality when acquiring Vietnamese nationality, subject to approval by the President of Vietnam. This applies to:

- Spouses or children of Vietnamese citizens.

- Individuals with Vietnamese parents or grandparents.

- Those with significant contributions to Vietnam.

- Minors applying for Vietnamese nationality through their parents.

These rules essentually make Vietnam a country that recognizes dual nationalities, a step that will surely help Vietnamese government to attract overseas talents who are descendants of Vietnamese origins.

4. Shortened Processing Time for Naturalization Applications

The processing time for naturalization applications has been reduced. For example:

- The Department of Justice must complete the file within 5 working days after receiving the verification results (previously 10 days).

- The Provincial People's Committee must review and propose within 5 working days after receiving the file from the Department of Justice (previously 10 days).

5. All Applications for Reacquisition of Vietnamese Nationality Will Be Considered

Previously, individuals who had lost Vietnamese nationality had to meet specific conditions to reacquire it. The 2025 amendment states that all applications for reacquisition will be reviewed.

6. Name Restoration for Reacquisition of Nationality

Individuals reacquiring Vietnamese nationality must restore their previous Vietnamese name. If they wish to retain their foreign name, they can use a combined name, which must be clearly stated in the decision to reacquire Vietnamese nationality.

These changes aim to simplify the process of acquiring and retaining Vietnamese nationality, making it more accessible to certain groups of people while ensuring compliance with legal and security requirements.
